ASP Releases a Statement Explaining the Decision

In response to Bobby’s interview, the ASP released this statement this morning:

LONG BEACH, New York/USA (Wednesday, September 7, 2011) – Bobby Martinez (USA), 29, has been disqualified from the ASP World Title competition in New York. What follows is the correspondence between the ASP Rules and Disciplinary Committee and Bobby Martinez:

Date of offense: 7 September 2011

Dear Bobby,
We are writing to officially notify you that you have breached Article 151, contained in the 2011 ASP International Rule Book (Rule Book).

Article 151 outlines that all Surfers shall not at any time damage the image of the sport of Surfing and can be found by clicking here.

Article 151 has been breached as a result of the numerous comments you made publicly in an interview on the webcast of the current ASP World Tour Event in New York City, which included the following language:

“First of all, I’d like to say (an the ASP are going to fine me) ‘cuz I don’t want to be a part of this dumb f***ing wannabe tennis tour. All these pro surfers want to be tennis players. They want to do a halfway cutoff. How the f*** is somebody who’s not even competing against our caliber of surfers ahead of 100 of us on the one world ratings. They’ve never been here. They’ve never fucking
made the right to surf against us, but now we’re ranked upon them. Come on now. That’s Bullshit. That’s why I ain’t going to these stupid contests no more. This is my last one because FTW, my sponsors is here and I just tell it like it is. This is my last one and I don’t like tennis. I don’t like the tour… Who gives a f***? You know what I mean?”

“I’ve been here before. I love this city. I’ll tell you right now, if my sponsor wasn’t here, I wouldn’t be here for this dumb contest. ASP? They f***ing…surfing’s going down the drain thanks to these people.”

The interview was conducted on the event live webcast being watched by a global audience, which includes many young children.

Article 147 of the Rule Book provides the ASP Rules & Discipline Committee with the authority to decide appropriate penalties to be issued where there is a breach of the Rule Book.

After careful consideration of these comments and taking into account your multiple offenses of this Article during 2011 that clearly “efface a pattern of unacceptable conduct,” the Rules and Discipline Committee have approved the following action in accordance with Article 147.03 of the

Rulebook:
Rule Breach: Article 151 – Damage to Surfing’s Image
Action: You are suspended from the ASP World Tour
IMMEDIATELY. You will not take part in the remainder of the World Tour Event currently underway in New York City. A
Rules and Discipline Report will be submitted to the ASP Board of Directors to consider expulsion for the remainder of the 2011 Surfing Season. Your suspension will remain in place until such time that the ASP Board of Directors have considered the Report.

Please refer to the ASP Rulebook at the link here for your rights to appeal this decision. Should you wish to have a written submission considered with the Rules and Discipline Report to be considered by the ASP Board of Directors in relation to this incident, please send it to rules@aspworldtour.com before 12 September 2011.

    Basically Article 147 translates to ‘ASP can make up rules, it says so in the rule book.” This is terrible.

    The reality is that the new people that will enter the CT after the cut off will never conted for the tittle, so we can conclude that this points system and the cut off is completely wrong, something has to be squared out to be fair!!!!!!!!!!!!!!!!!!!!!!

    Why does a prime event winner get 6500 points and a 4 star winner gets only a 1000 points. To be fair if a prime winner gets 6500 points equivalent to a CT quarter finalist then a 4 star winner should get 3250 point equivalent to a prime quartfinalist. All This is really hurting the young bloods trying to get it to the primes events also,.

    A Major league baseball player does not have to play AAA to earn a spot on a teem, they already proved to the world that they are worthy of being major leage players when they played AAA. I belive that surfers near the cut off should be the only one doing Prime Events to get their scores up.

    Oh for crying out loud…the children? What about the children watching surfers nearly die last week in Tahiti? What were the children doing watching a surf comp during a school day anyway?

    The ASP should be thanking BM for creating a little controversy and for putting some fire in this otherwise uneventful surfing event. This is supposed to be an extreme sport not a 151 rule golf game.

    The ASP is a JOKE and most pro surfers know it, but its all they have. What professional sport has a cut of in the middle of the year ????? NO ONE because it makes zero sense. I think pro surfing is kinda going down hill, once kelly gets off the tour it will be lame…… I predict one day slater will have a different tour that really represents the sport and not just BIG surf companies.

    The “dream tour” has become the “surf blown out knee high waves with poor judging in brazil tour.” The one world ranking and the mid season cut are both horrible ideas. Bobby is spot on. I hope other surfers have the guts to speak out but unfortunately professional contest surfing has been a story of turn your back on your brother so you can win his contest money. Let’s vote out Rob is his prime, let’s make a rule so Kelly can’t miss a first round heat, and lets push through Adriano to boost sales in Brazil.     Bobby is 100% right. The new ASP tour format is designed to let grom-like amatures tour the fanfare and publicity of their sponsors.

    It’s all about money–not about surfing. The ASP is trying to create a cult of images instead of excellent surfing because, well, images sell more clothes than ugly, boring surfers.

    The whole thing is ridiculous. Kelly Slater should take the tour away–like what he threatened before. Kelly Slater: you are responsible because you are the only person that can single-handedly accomplish this on behalf of surfers. Kelly, you owe it to the sport.

    1G% agree with Bobby. Does the ASP has really World Tour going on. Or is it not ? Those crapy waves (except casual hurricane swell that could give them at best 2 real decent days of surf) are not anywhere dream waves. Like Bobby’s as Kelly’s opinion on that matter. The dream tour is the right to surf dream waves against the dream guys, period. Not money. Everyone good professional surfer can handle 3-4+ foot sloppy, crappy waves. As a viewer, I’m not interested at all. I can watch any WQS so witness such talent (they are talented). As a viewer, I want to see Padang Padang, G-Land and some other freaking unbelievable waves that put the BEST all around surfers into challenge. That being said, I don’t like the way Bobby puked on ASP. He could have been evenly clear without being such a bitch. But I guess, if he erupted like this, I must be for a reason we don’t know. After all, Surfing is not the first sport to be ultra conservative. Try Baseball, Hockey, Soccer, one will be served. Good decision by the ASP, but shame on the ASP.

    i think you guys are missing the big picture the only way that you and your kidds get to watch these contests surfered all over the world is sponsers and there money, and if they need to sell more clothes and wax to gromms who respect and want to be these dream team surferes so be it, it is a bussiness you hippy ignorant pricks. get over it the 60s are long gone and forgotten. i have been privilaged to grow up in a surfing family and to hear different prespectives on surfing my whole life, i have had family and friends that have surfed on the tour and find it a bit offensive to hear Bobby saying these things because things dont go his way, well get over it thats life bud, do think everytime the CEO of a company makes a new rule all his staff pack up and leave and tell them off publicly. the ASP is not perfect no company is, thats life. the only positive thing for you now Bobby is that you are home, so go home lick your wounds and lets see if you can come back a better man, or leave the tour and follow whatever dreams you have but dont ruin it for everyone else.

    I am sure Bobby has a point…but there are better places and ways to make it so that the judging system can be improved. Let’s face it judging surfing will NEVER be right…that is the reason I left the contests a long time ago. While I may have missed my chance at ” the money” I am still able to make a living and surf.

    I hope it is not too late for Bobby to find another profession in these tough economic times…..The reality will hit once he is out of the “unreal surf world” and then the word J-O-B becomes almost overpowering at times. Then maybe we will hear some other types of complaints from him…albeit a little less dramatic.

    It appears to me that the ASP recent actions regarding it ruling on Bobby Martinez, say more about the ASP than Mr Martinez. The ASP looks spineless and out of control by it’s actions. ASP appears to be an insecure organization seizing the only opportunity it really has ever had to assert itself in a situation where (in this case it incorrectly assumes) it has nothing to lose. But in fact ASP has everything to lose by it’s poor judgement. ASP opened a window to its weak rulebook and it’s manipulations. ASP shows very poor judgment by going overboard and making an example of a Mr Martinez, someone who deserves a fine. A more secure organization could sustain verbal criticism…. and put a fine on Quiksilver and/or sponsors for any unedited language and a fine on Mr Martinez for the same.

    The endless complains about asp… teahupoo is no good, jeffreys is no good, nyc is no good. what is good ? i have may complain too: surfing has become an aerial acrobacy show, very boring, thre´s no more lines, no cutbacks, no snap backs, no tube riding, no floaters, it is just all about aerials now, surfing is loosing it´s beauty based on speed, power, etc
    maybe martinez is right for the worong reasons
